Sydney driver caught up in axe road rage attack on M1 Motorway is spared jailed

A young driver at the centre of a wild road rage attack that involved an axe being brandished from a moving vehicle on a busy motorway has been spared jail.

21-year-old David Nassir pleaded guilty to dangerous driving and driving in the right hand lane at the Downing Centre Local Court, Sydney[2], on Tuesday.  

Nassir was driving his ute with another passenger when they got involved in a spat with another driver on the M1 Motorway on November 19, 2022. 

The pair were heading to Newcastle from Sydney at the time. 

According to court documents, Nassir was seen swerving his white Nissan Navarra ute from one side of the road to the other. 

A motorist captured the shocking scenes on their phone of a dramatic high-speed encounter when Nassir and the driver of a dark grey ute locked horns.

Both vehicles took turns changing lanes on both sides of the road on the motorway. 

The careless driving went up a notch when a passenger of Mr Nassir's ute was seen leaning out the window and swinging an axe at the driver of the other ute. 

Mr Nassir is not alleged to have been seen brandishing the axe. The court heard it was the passenger of the vehicle who was waving the blade. 

A driver was heard in the footage telling the passenger who is filming the incident to 'just make sure you keep videoing'.

'They're slowing down … is that a hammer or something?' the passenger said when noticing an object being swung from Nassir's ute.

'F**k, it's an axe,' another person said.

Police charged Nassir a few days later, after they tracked the vehicle down to a relative of the man.

Mr Nassir's solicitor Javid Faiz told the court that Nasir is remorseful for his actions. 

'He understands his actions were not acceptable and he put peoples lives in danger on that day' he said.

'This has been a massive embarrassment to him'.  

Magistrate John Arms berated Nassir for allowing 'the behavior of the passenger' to swing the axe. 

'It's very dangerous, it takes your attention away from the road. I know they don't suggest you were speeding, but they do suggest you were driving badly,' he said. 

'He was driving a vehicle that can kill someone as much as someone who's 60 (years old) can kill someone.

'It was very immature.'

Nassir was convicted on both charges, had his license disqualified and was fined $500.
