A driver who stopped his car in the middle of a freeway to urinate has outraged motorists who called the move 'a fatality waiting to happen'.

The photo, which was posted to Facebook[2] on Tuesday, showed a stationary blue Havel on the Pacific Motorway on the Gold Coast[3], Queensland[4], with the door wide open.

A man with a long blonde pony-tail, casually dressed in black shorts is seen standing metres away on the edge of the busy road as cars and trucks slow down to avoid an accident.

'Absolute flog stops in the middle of the M1 and does this. Sadly this is why we have fatalities,' the original poster of the image wrote.

Another person wrote: 'We couldn't believe our eyes.'

'Traffic was slow, but was definitely not stationary and he was in absolutely no rush either.'

Others however, took a very different view.

'Nature waits for no-one ... as a matter of interest, how much did this delay your life by? Six car lengths?

Good on him,' one person said.

Urinating in a public place is an offence under the Summary Offences Act 2005 in Queensland legislation.

The maximum fine is £266.

A Queensland Police spokesperson told Daily Mail Australia the act of stopping a car in the middle of a lane was illegal.

'Other than in an emergency, stopping on the motorway is illegal and poses a significant risk to other road users,' they said.

The spokesperson said stopping can cause collisions that can lead to 'serious injuries and fatalities' and police urge motorists to follow the road rules so everyone is safe.

A Queensland Police spokesperson said there has been no arrest or charges at this stage regarding the man in the photo and police are asking witnesses or people with dashcam footage to come forward.
